General Terms and Conditions (T&C)
FollowMe GmbH
Contracting Party and Scope #
(1) The contracting party is FollowMe GmbH, Nelkenweg 6, 7310 Bad Ragaz, Switzerland (“FollowMe”).
(2) These General Terms and Conditions (T&C) apply to all products and services provided by FollowMe, in particular:
– the mobile app “FollowMe”,
– the Sunrise framework mobile plan (Switzerland only).
(3) Any deviating or supplementary terms set by the customer will not be recognised unless FollowMe has expressly agreed to their application in writing.
General Limitation of Liability #
(1) FollowMe’s total liability for all claims arising from or in connection with these T&C is – to the extent permitted by law – limited to the amount the customer has paid to FollowMe in the 12 months preceding the event giving rise to the damage.
(2) Liability for intent and gross negligence cannot be excluded (Art. 100 para. 1 of the Swiss Code of Obligations).
(3) Liability for slight negligence as well as for indirect damages, lost profits and consequential losses is excluded to the extent permitted by law.
Severability Clause #
Should individual provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a rule that comes as close as possible to the economic purpose of the invalid provision.
A. FollowMe App #
A1. Contractual Relationship #
The mobile app “FollowMe” is offered through the Apple App Store and Google Play Store. The purchase agreement for any in-app subscriptions or one-time purchases is concluded directly with Apple or Google. FollowMe provides certain functions and data access within the app but is not a party to the purchase agreement covering the subscription itself.
A2. Scope of Functionality #
(1) The core purpose of the app is the import, processing and sharing of roster data, as well as the provision of supplementary flight, live and statistical information.
(2) These functions rely on technical formats and data sources made available by airlines or third parties.
(3) If an airline changes its roster format, restricts access to it, or technically or organisationally prevents import, FollowMe assumes no warranty for the continued functionality of the import.
(4) In such cases there is no entitlement to compensation, refund, or any obligation on FollowMe to adapt the app to new formats or interfaces.
(5) FollowMe reserves the right to adjust, expand or technically modify the scope of the app at any time, provided that the core purpose – the exchange and display of roster data – remains essentially intact.
A3. Data Sources and Availability #
(1) Flight and position data are obtained from external third-party providers. FollowMe processes this data but does not collect it itself and has no influence on its content or timeliness.
(2) For certain airlines or individual flights, flight status, live position or complete data may not be available.
(3) Such limitations lie outside FollowMe’s sphere of influence and do not give rise to any claim for price reduction, refund or damages.
(4) Other app features (e.g. friends views or statistics) remain usable even if individual flight data is temporarily missing.
A4. Push Notifications #
(1) The type and scope of push notifications may vary depending on airline, data source or region.
(2) For certain airlines, additional notifications (e.g. inbound or layover alerts) may be provided, while for others these are not technically available.
(3) FollowMe strives to deliver a consistent user experience but cannot guarantee the availability of individual notification types.
(4) Push notifications are delivered via the service provider OneSignal (USA). Details can be found in the privacy policy.
A5. Liability #
(1) FollowMe is not liable for the accuracy, completeness or timeliness of flight, position or roster data supplied by third parties.
(2) The same applies to errors in the automated processing or interpretation of such data, for example incorrect imports, incomplete rosters, wrong times, flight numbers or assignments.
(3) Temporary unavailability or incorrect display of individual data, import or push services does not give rise to any entitlement to a refund or compensation.
(4) The general limitations of liability set out in these T&C apply.
A6. Refunds and Cancellation #
Refunds are handled exclusively through the respective app store operator (Apple / Google). Subscriptions can be cancelled at any time via the app store settings. Periods already paid for will not be refunded on a pro-rata basis.
B. Sunrise Framework Tariff Agreement (Switzerland only) #
B1. Contractual Relationship & Phone Number
By taking part in the FollowMe GmbH mobile subscription, you agree to these GTC as well as to the currently applicable terms of the mobile network partner Sunrise GmbH, in particular the service descriptions of the selected tariffs (Business Mobile Plus XL or Business Mobile Plus L), the General Terms and Conditions for Business Customers of Sunrise GmbH, and the respectively valid price, country and service fee overviews. These documents are available in their respective current versions at sunrise.ch/business and apply by analogy in the relationship between you and FollowMe. In the event of any conflict between these GTC and the Sunrise terms, these GTC shall prevail in the relationship between you and FollowMe, to the extent legally permissible.
Your mobile number will be integrated into FollowMe’s corporate framework agreement with Sunrise GmbH. You become the user of the number, while FollowMe remains the holder. If no existing number is ported, a new number will be assigned to you.
B2. Start, Minimum Term and Automatic Renewal
(1) The contract begins either upon successful porting of your existing number or upon activation of a new number by Sunrise.
(2) The minimum contract term is 24 months.
(3) IMPORTANT – AUTOMATIC RENEWAL: Unless the contract is terminated at least three months before the end of the minimum term or of a current renewal period, effective at the end of the respective period, it automatically renews for a further 24 months each time. FollowMe will remind you in good time before the end of the respective contract period, by e-mail or in-app notification, of the upcoming renewal and the notice period.
(4) Termination must be made by e-mail to mobile@followme.aero.
B3. Dependency on the Sunrise Framework Agreement
FollowMe’s offering is based on an overarching framework agreement with Sunrise GmbH. In the event that this framework agreement between FollowMe and Sunrise is terminated, your subscription automatically ends upon expiry of the framework agreement, even if your personal minimum term or renewal period has not yet been reached. In such a case you will be informed in good time so that you can, if you wish, arrange your own solution with Sunrise or another provider. In this exceptional case there is no entitlement to continuation of the offering or to compensation.
B4. Services & Responsibility
(1) You use one of the two Sunrise tariffs, Business Mobile Plus XL or Business Mobile Plus L, in accordance with the conditions provided by Sunrise. The currently valid price and country overview is linked via FollowMe. Not all countries and services are included – in particular, roaming outside the included zones as well as data usage after the included high-speed limit has been reached may result in reduced speeds or additional costs.
(2) You are obliged to bear all costs caused by your usage behaviour, even if they fall outside the scope of the inclusive tariff.
(3) Tariff switching during the term: During the contract term you may switch free of charge between the Business Mobile Plus L and XL tariffs, subject to the conditions agreed with the mobile network partner. Such a switch does not change the minimum contract term or the current contract period.
(4) Invoicing for the mobile services is carried out directly by Sunrise to the customer. As FollowMe, as holder of the framework agreement, is liable to Sunrise for the number, FollowMe is entitled, in the event of the customer’s default of payment, to assert and collect outstanding amounts as well as any resulting costs and the contractual penalty pursuant to B8 from the customer.
B5. Payment Obligations & Reminders
(1) In the event of default of payment, a free payment reminder is sent first, followed by a chargeable reminder with a CHF 40 reminder fee per reminder level.
(2) If the number is blocked due to default of payment, a fee of CHF 90 will be charged for unblocking after receipt of payment.
(3) Default interest, collection fees and further consequential costs may be charged in addition.
(4) If the customer fails to meet their payment obligations towards Sunrise and FollowMe, as holder of the framework agreement, incurs costs or claims as a result, the customer shall fully indemnify FollowMe against all resulting amounts.
B6. Termination Due to Poor Payment Behaviour
FollowMe may terminate the subscription without notice at any time if default of payment persists despite a reminder or if payment behaviour is repeatedly negative (e.g. direct debit reversals, debt enforcement proceedings). In such a case the number will be blocked. Outstanding claims as well as the contractual penalty pursuant to B8 remain due and may be subject to debt enforcement.
B7. Use & Liability
(1) The subscription is intended for use as designated within the meaning of the mobile network partner’s terms. Misuse, resale to third parties, or permanent predominant or exclusive use abroad that contravenes the mobile network partner’s terms is not permitted and may lead to restrictions or blocking by the mobile network partner.
(2) Upon request, a free additional SIM (Multi-Surf / extra SIM) is provided per subscription. Likewise, switching between eSIM and physical SIM card is free of charge, in each case subject to the conditions agreed with the mobile network partner. The SIM cards are personal and may not be passed on to third parties.
(3) The user is liable for all activities, data and content transmitted via the SIM card(s).
(4) FollowMe provides no warranty for continuous availability, network coverage or minimum bandwidth of the mobile network. The network performance of the mobile network partner is decisive.
B8. Early Termination – Contractual Penalty
IMPORTANT – CONTRACTUAL PENALTY: If the contract is terminated by the customer before the end of the minimum term or of a current renewal period – whether by termination, porting of the number to another provider, or other conduct that makes continuation of the contract impossible – a contractual penalty pursuant to Art. 160 et seq. of the Swiss Code of Obligations becomes due.
(1) The contractual penalty corresponds to the sum of the monthly subscription fees that would have accrued from the time of termination until the ordinary end of the respective current minimum term or renewal period.
(2) FollowMe may, in individual cases, waive the assertion of the contractual penalty in whole or in part. Such a waiver does not establish any legal entitlement for future cases or other customers.
(3) The contractual penalty is not consideration for a service and is not subject to VAT.
C. Data Protection & Communication #
By registering, you agree to receive emails and in-app notifications from us. These include:
- contract-relevant and system-relevant messages (e.g. invoices, security notices, contract amendments),
- information on new app versions, product changes and technical topics,
- occasional notices about new or related FollowMe products and services (e.g. mobile plans, app extensions, offers for flight crew).
You may unsubscribe from promotional or product-related messages at any time via the unsubscribe link in the respective email or by sending a message to support@followme.aero, without any disadvantage to your use of the app. Contract-relevant and system-relevant messages are excluded from this.
The FollowMe privacy policy governs the handling of your personal data in detail and is available at followme.aero.
D. Changes to the T&C #
(1) FollowMe may amend these T&C. The currently valid version is available at followme.aero.
(2) For material changes that disadvantage users – in particular regarding prices, main service obligations, contract terms, cancellation deadlines or liability – FollowMe will notify affected users with an active contract at least 30 days in advance by email or in-app notification. If no objection is raised within this period, the changes are deemed accepted. If a timely objection is raised, the user is entitled to terminate the contract with effect from the date the changes would have come into force.
(3) Editorial, clarifying or purely technical adjustments, as well as changes that are not to the disadvantage of users (e.g. updates to third-party provider names, linguistic corrections, addition of new optional features), are published in the current version on followme.aero without separate notification.
E. Support and Communication #
FollowMe support is provided exclusively by email at support@followme.aero or via the support platform at followme.aero/en/support. Telephone support is not available.
F. Applicable Law and Place of Jurisdiction #
Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Bad Ragaz, Switzerland. Mandatory places of jurisdiction under Swiss consumer law are reserved.
